CleverCook Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the CleverCook mobile application and related services (collectively, the “Service”).

The Service is operated by Sebastian Kintzel (individual developer) (“we,” “us,” or “our”).

By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2) Eligibility

You must be at least 13 years old to use the Service. If you are under the age of majority where you live, you may use the Service only with consent of a parent/guardian.

3) Accounts

Some features may require an account (for example, Sign in with Apple).

You agree to:

  • Keep your account and device secure.
  • Provide accurate information when required.
  • Notify us if you believe your account has been compromised.

We may suspend or terminate access as described in Section 15.

4) Subscriptions, Trials, and Purchases (Apple App Store)

Some features may require a paid subscription or one-time purchase.

  • Purchases and subscription billing are handled by Apple via the App Store.
  • Subscriptions may auto-renew unless cancelled at least 24 hours before the end of the current period.
  • You can manage or cancel subscriptions in your Apple ID settings.
  • Any free trial, if offered, converts to a paid subscription unless cancelled before the trial ends.
  • Refund requests are handled by Apple per Apple’s policies.

If there is a conflict between these Terms and Apple’s terms for billing/refunds, Apple’s terms control for those billing issues.

5) AI Features (Important Disclaimers)

The Service may generate recipes, ingredient substitutions, meal plans, nutrition estimates, and other suggestions using AI (“AI Output”).

You understand and agree:

  • AI Output may be inaccurate or incomplete. Always verify instructions, cook times, temperatures, and ingredient safety.
  • No medical advice. The Service does not provide medical, allergy, or dietary advice.
  • Food safety is your responsibility. You are responsible for safe food handling and preparation.
  • Nutrition is an estimate. Nutrition values are informational estimates and may differ from actual values.

We may limit, suspend, or disable AI features for safety, abuse prevention, legal compliance, or operational reasons.

6) Community and User Content

If the Service allows you to publish or share content (recipes, comments, images, etc.), you are responsible for what you post (“User Content”).

6.1 Your rights

You retain ownership of your User Content.

6.2 License you grant to us

You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, modify (for formatting/compatibility), distribute, and display your User Content to operate, improve, and provide the Service and sharing features you choose.

This license ends when you delete the User Content from the Service, except to the extent:

  • we must retain it for legal/compliance reasons,
  • it has been shared with others and they have not deleted it, or
  • it remains in backups for a limited period.

6.3 Prohibited content and behavior

You must not post, upload, or share User Content that is illegal, harmful, deceptive, defamatory, hateful, harassing, sexually explicit, infringing, or malicious (spam/malware/security bypass attempts).

We may remove content and/or restrict accounts for violations.

7) Acceptable Use

You agree not to misuse the Service, attempt unauthorized access, scrape, reverse engineer (except where legally permitted), interfere with security features, overload the Service, or use the Service to violate laws or others’ rights.

8) Intellectual Property

The Service (including software, design, logos, and non-user content) is owned by us and/or our licensors and is protected by applicable laws.

You receive a limited, personal, non-transferable, non-exclusive, revocable license to use the Service as intended.

9) Third-Party Services

The Service may integrate third-party services (for example Apple Sign In, App Store billing, iCloud/CloudKit syncing, AI providers, barcode/product lookup providers, and analytics). Your use of third-party services may be subject to their own terms and policies.

10) Privacy

Our collection and use of personal data is described in our Privacy Policy.

11) Availability and Changes

We may change, suspend, or discontinue any part of the Service at any time, including features, content, and pricing (subject to App Store rules). We do not guarantee uninterrupted availability.

12) Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim all warranties, express or implied.

13) Limitation of Liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages.

To the maximum extent permitted by law, our total liability will not exceed the greater of:

  • the amount you paid for the Service in the 12 months before the event giving rise to the claim, or
  • €50.

14) Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your User Content, misuse of the Service, or violation of these Terms.

15) Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, we are required to do so by law, or your use poses risk.

16) Changes to These Terms

We may update these Terms from time to time. Continued use after the effective date means you accept the updated Terms.

17) Governing Law and Jurisdiction (Germany)

These Terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-laws rules.

If you are a consumer and mandatory consumer protection laws in your country of residence apply, nothing in these Terms limits those rights.

18) EU Online Dispute Resolution / Consumer Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board (Verbraucherschlichtungsstelle), unless required by law.

19) Apple-Specific Terms (iOS)

If you downloaded the app from the Apple App Store, you acknowledge:

  • Apple is not a party to these Terms (except as a third-party beneficiary where applicable).
  • Apple has no obligation to provide maintenance or support.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any).
